The ICC Prosecutor Fatou Bensouda has filed an application to withdraw the charges against President. Uhuru Kenyatta of Kenya.
According to the ICC prosecurot, Mr Kenyatta was allegedly criminally responsible as an indirect co-perpetrator pursuant to article 25(3)(a) of the Rome Statute for the crimes against humanity of:
- murder (article 7(l)(a));
- deportation or forcible transfer (article 7(l)(d));
- rape (article 7(l)(g));
- persecution.
The ICC Judges had given the prosecutor 7 days to drop the case or strengthen it.
The case crumbled due to lack of witnesses and in the case where there were, they were not credible.
